3. USE OF THE WEBSITE

You may use our website only for lawful purposes.

You may not:

  • use the website in violation of applicable laws or regulations;

  • attempt to gain unauthorised access to the website, servers, customer accounts or payment systems;

  • introduce viruses, malware or other harmful technology;

  • interfere with the security or proper functioning of the website;

  • use automated systems to scrape or reproduce substantial parts of the website without permission;

  • submit false, fraudulent or misleading information;

  • impersonate another person or organisation;

  • use our content, branding or designs for unauthorised commercial purposes;

  • transmit unlawful content, spam or unauthorised advertising.

We may restrict or suspend access where reasonably necessary to protect our customers, systems, intellectual property or legal rights.

4. AGE AND AUTHORITY

By placing an order, you confirm that:

  • you are at least 18 years old; or

  • you have permission from a parent or legal guardian to place the order; and

  • you have the legal authority to enter into the purchase agreement.

When an order is placed on behalf of a company or organisation, the person placing the order confirms that they are authorised to act on its behalf.

5. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, photographs, dimensions, materials, colours, prices and availability are accurate.

Because our products include glass bottles, glassware and decorative products:

  • minor differences in colour, tone, dimensions, surface finish or appearance may occur;

  • colours may appear differently depending on the screen or device used;

  • small air bubbles or minor irregularities may occur naturally during glass production;

  • decorative designs may differ slightly in positioning or appearance;

  • sandblasted, printed or handmade elements may show minor variations between batches;

  • minor variations that do not affect normal use, safety or quality are not necessarily defects.

These variations do not affect your statutory right to receive a product that conforms to its description and is suitable for its intended purpose.

Product photographs are illustrative but are intended to represent each product as accurately as reasonably possible.

6. STANDARD, MADE-TO-ORDER AND PERSONALISED PRODUCTS

Our product range may include:

  • products held in stock;

  • standard products produced or finished after an order is placed;

  • products temporarily available on a made-to-order basis;

  • products made according to individual customer specifications;

  • clearly personalised or customised products.

A product is not automatically personalised or excluded from withdrawal merely because it is produced, decorated, sandblasted, printed or finished after the order is placed.

A standard design offered as part of our normal product range remains a standard product, even when it is made or finished after ordering.

Where a product is made according to your individual specifications or clearly personalised for you, this will be indicated on the relevant product page or during the ordering process.

Made-to-order, customised and personalised products may require additional production time.

7. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your shopping cart does not reserve it. A product may become unavailable before checkout is completed.

If a product becomes unavailable after you place an order, we will contact you. Depending on the circumstances, you may choose between:

  • waiting for the product to become available;

  • receiving an appropriate replacement, where available;

  • removing the unavailable product from your order; or

  • cancelling the affected part of the order and receiving a refund.

We may discontinue products or change our product range at any time.

8. PRICES, VAT AND IMPORT CHARGES

The price payable is the price displayed during checkout when you place your order.

Prices displayed to consumers include VAT where applicable, unless expressly stated otherwise.

Shipping costs, discounts, taxes and any other applicable charges will be displayed before you complete payment.

For deliveries outside the European Union, the recipient may be required to pay:

  • local import VAT;

  • customs duties;

  • customs-clearance fees;

  • carrier administration or handling charges;

  • other import-related costs.

Unless expressly stated otherwise during checkout, these charges are not included in our product prices or shipping charges and are payable by the recipient.

Further information is available in our Shipping Policy:

https://www.bluebottlelove.eu/pages/shipping-policy

Consumer prices must be shown including VAT and unavoidable additional charges; separate optional or delivery costs must be communicated clearly. (Autoriteit Consument & Markt)

9. OBVIOUS ERRORS

We may correct obvious typographical, technical, product-information or pricing errors.

If a product has been offered at a price that is clearly incorrect and a reasonable customer should have recognised the error, we may cancel the order before dispatch.

If payment has already been received, the affected amount will be refunded using the original payment method.

We will not cancel an order merely because a product was offered as part of a genuine promotion, discount or sale.

10. PLACING AN ORDER

Before submitting an order, you will have an opportunity to check and correct:

  • the selected products;

  • quantities;

  • personalisation details;

  • billing information;

  • delivery address;

  • contact information;

  • shipping method;

  • discount information;

  • the total price.

You are responsible for providing complete and accurate information.

After placing an order, you will receive an electronic order confirmation.

The purchase agreement is concluded when we accept your order and send the order confirmation, unless that message clearly states that it is only an acknowledgement that your order request has been received.

We may refuse or cancel an order where there is a reasonable and lawful reason, including:

  • suspected fraud or unauthorised payment;

  • an obvious pricing or technical error;

  • incomplete or incorrect customer information;

  • product unavailability;

  • delivery to an address or destination we do not serve;

  • unusually large quantities suggesting unauthorised resale;

  • previous serious misuse of our website, payment or return procedures;

  • legal, regulatory or product-safety restrictions.

If we cancel an order after receiving payment, we will refund the affected amount.

11. PAYMENT

Orders must be paid using one of the payment methods offered during checkout.

Available payment methods may differ depending on the customer’s country, currency, device and order value.

Payment services may be provided by Shopify Payments or another authorised payment provider. Payment providers may carry out identity, security and fraud-prevention checks.

We do not directly store complete payment-card details.

An order may be delayed, rejected or cancelled if payment is not authorised.

12. SHIPPING DESTINATIONS

We ship only to destinations listed in our Shipping Policy.

Our current delivery countries, shipping zones, rates, free-shipping thresholds, processing information and estimated delivery times are available at:

https://www.bluebottlelove.eu/pages/shipping-policy

We do not ship to countries or territories that are not specifically listed or available during checkout.

The delivery options shown during checkout are decisive for the order being placed.

13. PROCESSING, PRODUCTION AND DISPATCH

Orders are prepared and shipped from the Netherlands by our small, family-run business.

Our dispatch and return location is:

Blue Bottle Love Europe
De Hoge Brug 24-A
6581 AJ Malden
The Netherlands

This is not a public shop, showroom or customer collection point.

We normally prepare and dispatch parcels from Tuesday through Saturday.

Made-to-order, customised or personalised products may require additional production time. Product-specific processing times shown before purchase form part of the purchase agreement.

During public holidays, seasonal peaks, unusually busy periods or staff illness, processing and dispatch may occasionally take longer.

Estimated processing, dispatch and delivery times are not guaranteed delivery dates unless we expressly agree that delivery by a particular date is essential.

14. DELIVERY PERIODS AND DELAYS

Delivery may be affected by:

  • carrier delays;

  • customs processing;

  • public holidays;

  • adverse weather;

  • transport disruptions;

  • strikes;

  • unexpected shipment volumes;

  • remote-area delivery;

  • incorrect or incomplete address information;

  • circumstances outside our reasonable control.

If we cannot deliver within an agreed delivery period, we will inform you where reasonably possible.

Where required by applicable consumer law, you may give us an additional reasonable period in which to deliver. If we still fail to deliver within that period, you may cancel the affected purchase and receive a refund.

An additional delivery period may not be required where:

  • we have refused to deliver;

  • delivery by a specific date was expressly agreed as essential; or

  • it was clear before purchase that delivery by that date was essential.

If no separate delivery period has been agreed, the statutory starting point is delivery within 30 days. (ConsuWijzer)

15. DELIVERY ADDRESS

Please check your delivery address carefully before submitting your order.

Contact us as quickly as possible if you discover an error. We cannot guarantee that an address can be changed after an order has entered production, personalisation, packing or dispatch.

If an order is returned because the customer supplied an incorrect or incomplete address, we may deduct reasonable costs from the refund where legally permitted, including:

  • the original shipping costs;

  • carrier address-correction costs;

  • return-to-sender costs;

  • non-refundable customs, import or handling charges resulting from the incorrect address.

The customer may place a new order using the correct delivery address.

16. RISK DURING DELIVERY

For consumer orders, the risk of loss or damage remains with us until the products have been physically received by:

  • you;

  • a person authorised by you; or

  • another third party designated by you, other than the carrier.

Different rules may apply where you independently appoint a carrier that was not offered by us.

A carrier’s tracking status does not automatically remove our responsibility where the customer has not actually received the parcel.

Contact us at info@bluebottlelove.eu if tracking shows a parcel as delivered but you have not received it.

17. OWNERSHIP OF PRODUCTS

Ownership of the products transfers to you once we have received full payment.

Risk during delivery transfers as described in Section 16.

18. DAMAGED, INCORRECT, INCOMPLETE OR MISSING ORDERS

Please inspect your order after delivery.

Contact us as soon as reasonably possible if:

  • the parcel or product has been damaged;

  • an incorrect product was delivered;

  • an item or component is missing;

  • the order is incomplete;

  • a personalised product does not match the agreed specifications;

  • the parcel has not arrived within a reasonable period.

Email:

info@bluebottlelove.eu

Where possible, please retain:

  • the original packaging;

  • the shipping label;

  • the affected product;

  • photographs of the outer parcel;

  • photographs of the internal packaging;

  • photographs of the damaged or incorrect product.

This information helps us investigate the shipment and arrange an appropriate solution.

A request for photographs or prompt notification does not remove or restrict your statutory consumer rights.

Depending on the circumstances and applicable law, we may offer:

  • repair;

  • replacement;

  • completion of the order;

  • a proportionate price reduction;

  • cancellation and refund; or

  • another appropriate solution agreed with you.

Where a product is defective, damaged during delivery, incorrect or does not conform to the agreement, we will bear the reasonable cost of returning it.

19. STATUTORY RIGHT OF WITHDRAWAL

Consumers purchasing eligible products online normally have the statutory right to withdraw from the purchase agreement without giving a reason.

The withdrawal period is 14 days.

For an order containing one product, the period begins on the day after you, or a third party designated by you other than the carrier, receives the product.

When multiple products are purchased in one order but delivered separately, the period begins on the day after you, or a third party designated by you other than the carrier, receives the last product from that order.

When one product is delivered in multiple separate lots or pieces, the period begins on the day after the final lot or piece is received.

If the final day falls on a Saturday, Sunday or recognised public holiday, the deadline is extended until the end of the next working day.

You may also exercise an applicable right of withdrawal before delivery.

You must clearly inform us of your decision before the withdrawal period expires. You do not have to provide a reason.

The 14-day period, the last-delivered-item rule and the weekend or public-holiday extension follow the applicable consumer rules. (Autoriteit Consument & Markt)

20. HOW TO EXERCISE THE RIGHT OF WITHDRAWAL

You may exercise your right of withdrawal through:

  • the online withdrawal function on our website;

  • email to info@bluebottlelove.eu;

  • the European model withdrawal form; or

  • another clear and unambiguous written statement.

Our withdrawal page is available at:

https://www.bluebottlelove.eu/pages/withdrawal

You may be asked to provide information reasonably necessary to identify the order and products concerned, such as:

  • your full name;

  • your email address;

  • your order number;

  • the product or products concerned;

  • the date on which the final product was received.

After an online withdrawal request is submitted, an electronic confirmation will be provided.

Use of the online function is not the only way to exercise the statutory right. If the function is unavailable or does not display an eligible order or product, you may still submit a clear withdrawal statement by email before the deadline.

A clear online withdrawal function and electronic acknowledgement are required for covered online agreements from June 2026. (Autoriteit Consument & Markt)

21. RETURNING PRODUCTS AFTER WITHDRAWAL

After informing us that you are withdrawing, you must send the products back within a further 14 days.

Eligible returns must be sent to:

Blue Bottle Love Europe – Returns
De Hoge Brug 24-A
6581 AJ Malden
The Netherlands

Please include sufficient information inside the parcel so that we can identify the return, including:

  • your full name;

  • your order number;

  • the email address used for the order;

  • the product or products being returned.

Do not send returns to our registered business address in Doorwerth.

For an ordinary withdrawal, the customer:

  • arranges the return shipment;

  • selects the return carrier;

  • pays the direct return-postage and packaging costs;

  • remains responsible for adequate return packaging.

We pay or reimburse reasonable return costs where:

  • a product is defective;

  • a product was damaged before or during delivery;

  • an incorrect product was delivered;

  • the product does not conform to the agreement;

  • the return results from an error for which we are responsible;

  • we expressly agree to pay the costs; or

  • applicable law requires us to pay them.

We recommend using:

  • secure packaging suitable for fragile glass products;

  • adequate internal protection;

  • a trackable shipping service;

  • proof of posting.

We do not charge a restocking fee, handling fee or administration fee for a valid statutory withdrawal.

22. INSPECTING PRODUCTS AND REDUCTION IN VALUE

During the withdrawal period, you may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning.

You may inspect the product in the same way that you would normally be permitted to inspect it in a physical shop.

Opening ordinary shipping packaging does not by itself remove the statutory right of withdrawal.

Original protective packaging should be returned where reasonably possible, particularly because the products are made from fragile glass. However, the absence or damage of ordinary packaging does not automatically remove the statutory right.

You may be responsible for a reduction in value if the product has been used or handled beyond what was reasonably necessary to inspect it.

Any deduction will be reasonable, proportionate and based on the actual reduction in value. (EUR-Lex)

23. REFUNDS AFTER WITHDRAWAL

When you validly withdraw from the entire order, we will refund:

  • the price paid for the returned products; and

  • the cost of the least expensive standard delivery method offered for that order.

If you selected a more expensive priority, insured or express delivery method, the additional amount above the least expensive standard delivery option does not have to be refunded.

When you withdraw from only part of an order, the original delivery costs are normally not refunded where the remaining products were still delivered.

We will process the refund within 14 days after receiving your withdrawal notification.

We may withhold the refund until:

  • we have received the returned products; or

  • you provide sufficient evidence that the products have been sent back,

whichever occurs first.

Refunds will normally be made using the original payment method unless you expressly agree to another method.

We will not charge a fee for processing the refund.

Your bank, card issuer or payment provider may require additional time before the refund appears in your account.

The requirement to reimburse the original standard-delivery costs applies when the consumer withdraws from the complete order. (Autoriteit Consument & Markt)

24. CANCELLING AN UNFULFILLED ITEM

Customers may request cancellation of an eligible item through our online cancellation function for as long as that item remains unfulfilled in our order system.

An item is considered unfulfilled until it has been marked as fulfilled in Shopify.

A cancellation request may also be submitted by emailing:

info@bluebottlelove.eu

When an eligible cancellation request is submitted before fulfilment, the affected item or order will be cancelled and refunded.

Once an item has been marked as fulfilled, the online self-service cancellation function is no longer available. At that stage, the order may already have been packed, transferred to the carrier or dispatched.

We cannot guarantee that an order can be stopped or recalled after fulfilment.

This self-service cancellation option is an additional service and does not restrict statutory consumer rights.

For eligible standard, non-personalised products:

  • fulfilment does not remove the statutory right of withdrawal;

  • you may notify us of withdrawal before delivery;

  • you may notify us within the applicable period after delivery.

Shopify’s cancellation rules apply to unfulfilled items, while its return rules apply to fulfilled items. (Shopify Help Center)

25. PERSONALISED AND CUSTOM-MADE PRODUCTS

The statutory right of withdrawal does not apply to products that are:

  • made according to specifications individually provided or selected by the customer; or

  • clearly personalised for the customer.

Examples may include products featuring:

  • a customer’s name;

  • individually selected wording;

  • a personal date or message;

  • a customer-supplied logo;

  • a customer-supplied photograph or illustration;

  • individually requested artwork;

  • an individually requested engraving;

  • a specially requested symbol, combination, layout or design;

  • another customer-specific modification not offered as a standard product.

Where this exception applies, it will be clearly communicated on the product page or during the ordering process before the order is placed.

Such products may be designated as personalised, custom-made or final sale in our online system.

A product is not excluded from the statutory right of withdrawal merely because:

  • it is produced after the order is placed;

  • it is temporarily not held in stock;

  • it has a longer processing or production time;

  • it is a standard made-to-order product;

  • it uses a standard design from our normal range;

  • it was purchased during a sale or promotion.

The legal exception concerns goods made to the consumer’s specifications or clearly personalised; it does not automatically cover every item produced after an order is placed. (EUR-Lex)

26. PERSONALISED PRODUCTS WITH A DEFECT OR ERROR

Personalised and custom-made products remain protected by statutory conformity and guarantee rights.

A personalised or custom-made product may still qualify for repair, replacement, a price reduction or refund when it is:

  • damaged;

  • defective;

  • incomplete;

  • incorrectly produced;

  • different from the agreed design;

  • different from the specifications submitted with the order.

A final-sale designation applies only to a lawful exclusion from change-of-mind cancellation or withdrawal.

It does not remove your rights when a product is defective, damaged or incorrectly produced.

27. OTHER EXCEPTIONS TO WITHDRAWAL

The statutory right of withdrawal may also not apply where another legal exception applies, including:

  • sealed goods unsuitable for return for health-protection or hygiene reasons after the seal has been broken;

  • goods that deteriorate or expire rapidly;

  • digital content supplied immediately after the customer expressly consented to performance beginning and acknowledged the loss of the withdrawal right;

  • other products or services specifically excluded under applicable law.

An exception applies only where its legal requirements have been met and the customer was properly informed before placing the order.

28. SALE AND FINAL-SALE PRODUCTS

A reduced price does not by itself remove statutory withdrawal, return or conformity rights.

Standard products purchased during a sale or promotion remain eligible for the statutory right of withdrawal unless a separate legal exception applies.

Products should only be marked as final sale where they are genuinely:

  • personalised;

  • customised;

  • made according to individual customer specifications; or

  • covered by another applicable legal exception.

A standard made-to-order product must not be treated as final sale solely because it was produced after the order was placed.

A final-sale designation does not remove rights relating to products that are defective, damaged, incorrectly supplied or do not conform to the purchase agreement.

29. EXCHANGES

We do not guarantee direct exchanges.

For eligible standard products, the quickest procedure is normally to:

  1. return the original product in accordance with the applicable return conditions; and

  2. place a new order for the preferred product.

Where practical, customer service may agree to another exchange procedure.

A replacement provided because a product is defective, damaged or incorrectly supplied is handled separately from an ordinary exchange.

30. LEGAL GUARANTEE AND CONFORMITY

Consumers are entitled to receive products that:

  • match their description;

  • possess the quality and characteristics reasonably expected;

  • are suitable for their normal intended purpose;

  • correspond with an agreed sample, design or specification;

  • are supplied with promised accessories and instructions;

  • have the durability that may reasonably be expected.

Under Dutch law, statutory conformity does not have one single fixed guarantee period. The relevant period depends on the nature, price and expected lifespan of the product.

Consumers in other countries retain any mandatory legal guarantee or conformity rights applicable in their country.

Where a product does not conform to the purchase agreement, the customer may be entitled to:

  • free repair;

  • free replacement;

  • a proportionate price reduction; or

  • termination of the purchase agreement and a refund,

depending on the circumstances and applicable law.

Normal wear, accidental damage, improper handling, improper cleaning, freezing, strong impact, sudden temperature changes or failure to follow reasonable instructions are not manufacturing defects.

Commercial or manufacturer guarantees are additional to statutory rights and do not replace them. (ConsuWijzer)

31. GLASS PRODUCT SAFETY AND CARE

Blue Bottle Love products are made from glass and must be handled carefully.

Glass products may break, chip or crack when they are:

  • dropped;

  • struck against a hard surface;

  • exposed to strong impact;

  • exposed to freezing temperatures while containing liquid;

  • exposed to sudden or extreme temperature changes;

  • cleaned or handled contrary to the instructions;

  • placed in unsuitable appliances or environments.

Always inspect a glass product before use.

Do not use a bottle if it is cracked, chipped or otherwise damaged.

Dispose of broken glass safely and keep damaged products and broken glass away from children and animals.

Products should be used, cleaned, stored and transported in accordance with:

  • the product description;

  • instructions supplied with the product;

  • our Care & Uses page.

Care information:

https://www.bluebottlelove.eu/pages/care

Failure to follow reasonable care and safety instructions may affect whether subsequent damage qualifies as a product defect.

This does not restrict rights concerning defects that were already present when the product was delivered.

32. INFORMATION ABOUT WATER AND WELLBEING

Content on our website concerning water, colour, sunlight, intention, frequency, affirmations, Ho’oponopono, Dr. Masaru Emoto or other wellbeing-related subjects is provided for general educational, cultural and inspirational purposes.

This content is not medical advice and is not intended to:

  • diagnose a medical condition;

  • treat or cure an illness;

  • prevent disease;

  • replace professional medical advice;

  • guarantee a particular physical, emotional or spiritual result.

Blue Bottle Love bottles are not medical devices.

Individual experiences, beliefs and interpretations may differ.

Customers should seek appropriate professional advice concerning medical conditions, hydration requirements or other health-related matters.

33. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions, including:

  • a validity period;

  • a minimum order value;

  • excluded products;

  • limited availability;

  • restrictions on combining discounts;

  • a maximum number of uses;

  • restrictions per customer, email address or household.

Unless expressly stated otherwise:

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • discounts cannot be applied retrospectively;

  • free-shipping thresholds are calculated after discounts;

  • promotions do not reduce statutory consumer rights.

We may cancel or correct a promotion containing an obvious error or being used fraudulently, where permitted by law.

34. GIFT CARDS

Where gift cards are offered, the conditions displayed when purchasing or using the gift card will apply.

Gift cards:

  • cannot normally be exchanged for cash;

  • may not be used unlawfully or fraudulently;

  • may be cancelled where obtained through fraud or unauthorised payment;

  • remain subject to mandatory statutory rights.

Any applicable expiry period or restriction will be stated before purchase.

35. CUSTOMER ACCOUNTS

You may be able to create a customer account.

You are responsible for:

  • keeping your login information confidential;

  • providing accurate account information;

  • informing us of suspected unauthorised use;

  • activities carried out through your account where caused by your failure to protect your login information.

We may suspend an account where reasonably necessary because of fraud, security risks, unlawful activity or serious misuse.

You may request deletion of your account, subject to legal obligations requiring us to retain certain transaction, tax or accounting records.

36. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its contents are owned by or licensed to Peace Of I Ecommerce, Blue Bottle Love or the applicable rights holder.

Protected content may include:

  • brand names;

  • logos;

  • product designs;

  • decorative artwork;

  • photographs;

  • videos;

  • written content;

  • product descriptions;

  • page layouts;

  • graphics;

  • illustrations;

  • downloadable materials;

  • trademarks and trade names.

You may use the website for personal, non-commercial purposes.

You may not copy, reproduce, modify, publish, distribute, sell, license or commercially exploit protected content without prior written permission, except where permitted by law.

Purchasing a physical product does not transfer intellectual-property rights in the artwork, logo, design or branding appearing on that product.

37. CUSTOMER-SUPPLIED CONTENT

Customers who provide a logo, photograph, illustration, wording, symbol or other material for a personalised product confirm that they have the right to provide and use that material.

Customers must not submit content that:

  • infringes intellectual-property rights;

  • violates privacy or publicity rights;

  • is unlawful, discriminatory, threatening or defamatory;

  • contains fraudulent or misleading information;

  • contains malware or harmful code.

We may refuse to produce a personalised product where the supplied material may violate applicable law or third-party rights.

The customer remains responsible for obtaining any permission required to use customer-supplied material.

38. REVIEWS, FEEDBACK AND USER CONTENT

When you voluntarily submit a review, photograph, testimonial, comment or other content, you confirm that:

  • the content is accurate and based on your genuine experience;

  • you have the right to submit it;

  • it does not infringe third-party rights;

  • it is not unlawful, threatening, discriminatory, defamatory or misleading;

  • it does not contain malware, spam or unauthorised advertising.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use submitted content for operating and promoting Blue Bottle Love, subject to applicable privacy and consumer laws.

We will not present paid or incentivised reviews as independent reviews without appropriate disclosure.

We may moderate or remove content that violates these Terms or applicable law.

39. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to third-party websites or use services supplied by third parties, including:

  • Shopify;

  • payment providers;

  • delivery carriers;

  • social-media services;

  • analytics providers;

  • affiliate services.

Third-party websites and services are governed by their own terms and privacy policies.

We are not responsible for third-party content or services outside our reasonable control.

We remain responsible for our own mandatory legal obligations relating to purchases made through our online store.

40. WEBSITE AVAILABILITY

We aim to keep the website available and secure but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or restrict access because of:

  • maintenance;

  • security updates;

  • technical problems;

  • system improvements;

  • service-provider interruptions;

  • circumstances outside our reasonable control.

This does not affect agreements already concluded or statutory rights relating to existing orders.

41. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing excludes or restricts:

  • mandatory statutory consumer rights;

  • liability for death or personal injury caused by negligence where it cannot legally be excluded;

  • liability for fraud or fraudulent misrepresentation;

  • liability for intentional misconduct or deliberate recklessness;

  • liability under mandatory product-safety or product-liability law;

  • liability for failing to supply products that conform to the purchase agreement.

For consumer purchases, we are responsible for losses that are a foreseeable consequence of our breach of the agreement or failure to use reasonable care.

We are not responsible for:

  • losses that were not reasonably foreseeable;

  • business losses arising from a consumer purchase;

  • loss caused by incorrect information supplied by the customer;

  • damage caused by misuse or failure to follow reasonable instructions;

  • delays or failures caused exclusively by circumstances outside our reasonable control, except where mandatory law provides otherwise.

Nothing in this section prevents a consumer from claiming remedies available under applicable law.

42. FORCE MAJEURE

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including:

  • natural disasters;

  • extreme weather;

  • fire or flooding;

  • war, terrorism or civil unrest;

  • epidemics or government restrictions;

  • major transport disruption;

  • strikes not limited to our own staff;

  • customs disruption;

  • interruption of electricity, internet or communications infrastructure;

  • carrier-network failures;

  • legal or regulatory measures.

We will take reasonable steps to minimise disruption and inform affected customers where appropriate.

If performance becomes impossible or is delayed for an unreasonable period, the customer may have the right to cancel the affected purchase and receive a refund.

43. PERSONAL DATA AND PRIVACY

We process personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation where applicable.

Information about the personal data we collect, why we use it, the parties with whom it may be shared and your privacy rights is available in our Privacy Policy:

Please contact us first if you have a complaint so that we have an opportunity to investigate and resolve it.

Correspondence address:

Please note: this is not a visitation, showroom, dispatch or return address.

Please include, where relevant:

  • your full name;

  • your order number;

  • a clear description of the issue;

  • the outcome you are requesting;

  • relevant photographs or supporting documents.

We aim to acknowledge complaints within a reasonable period and provide a substantive response as soon as reasonably possible.

Consumers residing in another European country may also seek information or assistance from their national consumer authority or the European Consumer Centres Network.

45. GOVERNING LAW

These Terms of Service and agreements concluded through our website are governed by Dutch law.

For consumers, this choice of law does not deprive you of protection provided by mandatory consumer laws that would otherwise apply in your country of habitual residence.

46. JURISDICTION

Disputes may be submitted to a competent Dutch court, subject to applicable consumer-jurisdiction rules.

A consumer may also have the right to bring proceedings before the competent courts of the country or place where the consumer is domiciled.

We will not require a consumer to submit a dispute exclusively to a Dutch court where mandatory law gives that consumer the right to use another competent court.

47. BUSINESS PURCHASES

The statutory consumer right of withdrawal applies to natural persons acting outside their trade, business, craft or profession.

Business customers do not automatically have the same statutory right of withdrawal. (ondernemersplein.overheid.nl)

Returns or cancellations for business purchases are accepted where:

  • mandatory law requires this;

  • the product is defective or does not conform to the agreement; or

  • we expressly agree to the return or cancellation in writing.

48. CHANGES TO THESE TERMS

We may update these Terms of Service to reflect:

  • changes in law;

  • changes to our business;

  • new services or website functions;

  • changes to payment, production, delivery, cancellation or return processes;

  • security or operational requirements.

The version applicable to an order is the version available when that order was placed.

Material changes will not retrospectively reduce rights arising from an existing purchase agreement.

The latest version and update date will be published on this page.

49. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent legally permitted or removed where necessary.

The remaining provisions will continue to apply.

50. NO WAIVER

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

A waiver is effective only where it is clearly communicated and legally valid.

51. ENTIRE AGREEMENT

These Terms of Service, together with the policies, product information and order information referenced in them, form the agreement between Blue Bottle Love Europe and the customer regarding use of the website and purchases made through it.

They do not exclude statements or commitments that legally form part of the agreement, including information provided in product descriptions, checkout information, order confirmations or direct written communications.
